										<content:encoded><![CDATA[<p>In these uncertain times in view of the Covid-19 Climate, it is important to be prepared for the worse-case scenario. As it may not be possible to consult a lawyer immediately, we provide a brief checklist below to prepare a Will at home.</p>
<p>We advise that the Will be registered, notarized, be printed on a stamp paper and preferably drafted by a counsel but in case of emergency, a self-made Will is better than no Will at all.</p>
<p>Please consider this check-list as a Guideline only.</p>
<ul>
<li>Make a list of all immovable properties – whether held solely or jointly.</li>
<li>Make a list of all movable properties – such as vehicles, jewellery, heirloom.</li>
<li>Make a list of all insurance policies – health, life-insurance.</li>
<li>Make a list of all investments – mutual funds, fixed deposits, recurring deposits, etc. (include names of nominees).</li>
<li>Make a list of all bank accounts along with branch information, bank account details, lockers if any (include names of nominees).</li>
<li>Attach documents wherever possible. (Eg. Property deeds, investment information, pan card, aadhaar card, voters id, etc.)</li>
<li>Determine the person you are bequeathing property to with as much detail as possible.</li>
<li>Keep two witnesses, preferably not the people who are receiving the bequests.</li>
<li>If you have time, get it registered. A registered Will is<br />
air-tight and can sustain litigation.</li>
<li>Make multiple notarized copies/ photocopies and give it to at least 2-3 people. Do not leave it in a locker.</li>
</ul>

Prohibition and Redressal) Act, 2013 [Act No. 14 of 2013]</u></strong></p>
<p><strong>Brief Information Bulletin for Employers</strong></p>
<p>The Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, 2013 [Act No. 14 of 2013] or commonly called the POSH Act was enacted to protect the interests of women at the workplace and to make the workplace safe for women and lays down directives to employers/ government to provide a platform for women to voice their concerns in the event of any untoward incident and for redressal. It is meant to protect the dignity and personal liberty of a woman at the workplace and entities must take it seriously.</p>
<p><strong><u>Where does the Act apply to?</u></strong></p>
<p>ALL workplaces in India. The Act protects victims of sexual harassment at the WORKPLACE, so it is necessary that the incident have occurred at workplace, which includes ‘extended workplace’ meaning places outside of the physical place of the Employer wherever authorized employment is being carried out. However, this definition of ‘workplace’ is a grey area, and it will have to be examined on a case-by-case basis. The Act applies individually to every branch/ office of the Employer.</p>
<p><strong><u>Who does the Act apply to?</u></strong></p>
<p>ALL entities employing more than 10 persons and the Government as well.</p>
<p><strong><u>Who is protected under the Act?</u></strong></p>
<p>All female persons associated with the Employer. This includes part-time or full-time employees, consultants, contract-labourers, female volunteers, interns/ trainees, regardless of their designation/ role in the company and also includes vendors, clients, and customers.</p>
<p><strong><u>What is sexual harassment?</u></strong></p>
<p>The Act has a broad definition for what act constitutes as Sexual Harassment, but it rests on the basic principle that all act (physical conduct, spoken words) that is UNWELCOME and UNWANTED received by a woman which creates a hostile environment at the workplace/ place of employment for the woman to work in. Again, since this definition is broad, the behaviour will have to be examined on a case-by-case basis.</p>
<p><strong><u>What is the role of the Employer?</u></strong></p>
<p><strong>Mandatory:</strong></p>
<ul>
<li>Shall provide a safe working environment.</li>
<li>Shall Organize Workshops and awareness programmes regularly.</li>
<li>Shall Educate and sensitize the employees to the definition of ‘sexual harassment’.</li>
<li>Shall establish an Internal Complaints Committee.</li>
<li>Shall display in the premises information regarding the rules, penalties, constitution of the Internal Complaints Committee.</li>
<li>Shall organize orientation/ training programmes for the Internal Complaints Committee.</li>
<li>Shall assist, co-operate, and provide assistance to the Internal Complaints Committee.</li>
<li>Shall monitor the meetings of the Internal Complaints Committee regarding submission of Report.</li>
<li>Shall provide assistance to the victim if she chooses to file a complaint under any law.</li>
<li>Shall provide for treating ‘sexual harassment’ as a misconduct/ violation of employment rules.</li>
<li>Shall submit an Annual Report.</li>
<li>Shall implement the Recommendations/ Report of the Internal Complaints Committee</li>
</ul>
<p><strong>Advisory:</strong></p>
<ul>
<li>Create a gender-neutral workplace and provide rules and regulations for safety of women.</li>
<li>Prepare information bulletins and circulate it regularly.</li>
<li>Draft and create a POSH Policy.</li>
<li>May extend the protection against sexual harassment to men as well.</li>
</ul>
<p><strong><u>What is the role of the Internal Complaints Committee?</u></strong></p>
<p>The Internal Complaints Committee (“ICC”) is an independent panel to be set-up by the Employer at every branch/ office/ factory where more than 10 persons are employed. The ICC has to follow the rules and procedures as laid down under the Act.</p>
<p>The role of the ICC is to provide a platform for victims of sexual harassment at the workplace to file their complaints/ grievances and be heard. The ICC must follow the principles of natural justice and provide the complainant as well as the person accused of the offence a fair hearing while maintaining discretion, respecting privacy, and give due regard to the reputation of the persons involved.</p>
<p><strong><u>Constitution of the ICC:</u></strong></p>
<ul>
<li>1 Presiding Officer – senior level employee of the Employer</li>
<li>2 or more Members – from within the organization or outside, being experienced with social of legal work.</li>
<li>1 external member – a lawyer, NGO worker, etc.</li>
<li>A minimum of 50% of this Committee must comprise of women.</li>
<li>The term of such ICC is 3 years so the panel must be chosen wisely.</li>
<li>The Presiding Member + 2 members must be present for conducting any enquiry.</li>
</ul>
<p><strong><u>Some tips on choosing an ICC:</u></strong></p>
<ul>
<li>The ICC must comprise of persons who have experience in dealing with such sensitive matters.</li>
<li>The ICC conducting the enquiry should ideally be odd-number to prevent a split-vote or have a mechanism in place in the event of a split-vote.</li>
<li>The members of the ICC must undergo regular trainings with regard to the provisions of the POSH Act as well as recent judgments of the Hon’ble High Courts and the Hon’ble Supreme Court is very important.</li>
</ul>
<p><strong><u>Powers of the ICC</u></strong></p>
<ul>
<li>Recording the complaint/ statement of the victim</li>
<li>Accepting the response of the Accused</li>
<li>Summoning witnesses</li>
<li>Requiring production of documents</li>
<li>Any other agenda, as required.</li>
</ul>
<p><strong><u>What about non-compliance by the Employer?</u></strong></p>
<p>There is a monetary penalty under the POSH Act for non-compliance of this mandatory Act.</p>
<p><strong><u>What about aggrieved women in society at large?</u></strong></p>
<p>For a victim who perhaps does not have a redressal option (e.g., an employee/ client/ vendor/ customer of an entity not required to comply with the POSH Act), or for a victim associated with the unorganized sector, the Government is required to set up Local Committees which shall perform like an ICC for redressal of the victims.</p>
<p><strong><u>Additional Points:</u></strong></p>
<p><em>Firstly, </em>it is advisable for Employers to make efforts to educate, inform and sensitize their employees regarding the law, and the redressal mechanism available for aggrieved women.</p>
<p><em>Secondly, </em>the Employees’ handbook should ideally include the Employer’s POSH Policy and provide a general understanding of the Act and the role of the internal complaints committee.</p>
<p><em>Thirdly, </em>the Employer could also prepare an information package with detailed information on filing of complaints, hearings of the ICC, penalties/ punishments for offences proved, and so on to prevent ambiguity. The more detailed the information provided by the employer, the easier it will be for the Employer to prevent such incidents in the workplace, and also provide a safe environment for women at the workplace.</p>
<p><em>Fourthly, </em>it is advisable for the Employer to be prepared to offer counselling for the victim as well as the accused.</p>
<p><em>Fifthly,</em> the Employer must respect the privacy and dignity, and maintain discretion in handling such complaints.</p>
<p>It is to be noted that whether there is a complaint or not, the Employer has to keep in place the POSH Policy, the rules and regulations and establish the internal complaints committee at all times. The Employer cannot wait for a complaint to be filed before making provisions for the compliance of the Act.</p>

<p>A WILL is best possible document through which a person can make arrangements for handling his or her affairs after the demise. When a WILL is registered, only the ownership of the assets can be questioned, not the bequest of a property to a beneficiary.</p>
<p><strong>A WILL general has three important essentials:</strong></p>
<p>A Testator: The person making the Will</p>
<p>A Bequest: the grant of a movable or immovable property</p>
<p>Codicil: A modification of the Will</p>
<p>There are no rules for what can or cannot be in a WILL except that it should be owned by the Testator. A WILL can record the manner in which a person’s assets such as immovable property (apartment, house, office, any piece of land) and movable properties (share certificates, jewelry, household items, vehicles, artifacts, heirlooms etc.) are to be dealt with in the event of demise.</p>
<p>A WILL is the best way to ensure that the wishes of a person are carried out after demise. In fact, a WILL can even record the person’s last wishes in respect of rituals and funeral arrangements that one wants carried out.</p>
<p><strong>Benefits of a Will</strong></p>
<ul>
<li>In the absence of a Will, the decisions on distribution of assets after a person’s death is decided by the Law prevailing in India as per their personal law. (Hindu Succession Act, Indian Succession Act, etc.). The legal heir of the Deceased person has to file a Probate and Succession Case in the jurisdictional Court asking the Court to pronounce the persons who file the case as ‘legal heirs’. Such litigation is time-consuming and an unnecessary expenditure on the grieving family members of the Deceased person and can be avoided. In case of a Hindu Undivided Family, or a dispute in the family, a long-drawn out legal battle may ensue leading to unpleasant family interactions and financial strain.</li>
<li>The grieving family members do not have to fight amongst each other or undergo the legal process.</li>
<li>The ultimate Will of the Testator is respected and not the rule of law. As such, Testator can give his movable and immovable properties to the person or institution of his or her choice, and not necessarily blood-relatives only.</li>
</ul>
<p><strong>How are Wills made?</strong></p>
<ul>
<li>The Testator must make a list of all the assets that the Testator owns and attach copies of the relevant documents for ease of execution of the Will. The more detailed the better! Eg. Life Insurance Policy, Share Certificates, Fixed Deposit statement, Bank Account information, etc.</li>
<li>The WILL must be signed by the Testator, an Executor and 2 witnesses who can ensure that the WILL is given effect to after Death of the Testator. The choice of Executor and Witnesses must be made carefully, as it is a fiduciary role. It can be a friend, family member, trusted person and even a lawyer.</li>
<li>Once a WILL is made, it should be handed over to a trustworthy person to execute after the Death. Ideally, the Executor must be someone close enough to the family to know of the death so that he or she can inform the family of the existence of the WILL, but not have any vested interest in the execution of WILL so as to render such Executor incompetent.</li>
</ul>
<p><strong>Registration of a Will</strong></p>
<p>While registration of a WILL is not mandatory, it is required for enforcing it. Once a WILL is registered, it is an absolute document, and no one can question its authenticity by challenging it.</p>
<p>In fact, if there are multiple WILLS executed during the lifetime of a person, registration helps distinguish the most recent WILL.</p>
<p><strong>Changes in a Will</strong></p>
<p>It is possible to amend or modify a WILL if there any changes in the list of assets (deletion or addition). As such, the WILL can be updated by executing a ‘Codicil’ to the WILL. There can be multiple Codicils but if the original WILL changes drastically, then it is advisable to revoke the earlier WILL and execute a new WILL. It is highly recommended that the Codicil be registered and kept along with the Main WILL. As such, it is also highly recommended to ensure that the Executor is aware of the Codicil.</p>

<p>Dishonour of a Cheque or commonly referred Cheque Bounce cases occur when the Receiver of a Cheque deposits the cheque, during its period of validity, with the bank, and the bank gives an endorsement that cheque is dishonoured i.e. the payment is not received. The Dishonour of cheque can be for various reasons such as Insufficient Funds, Exceeds Arrangement, Account Closed, Stop Payment.</p>
<p>In the event of such dishonour of a cheque, the timeline plays a particularly important role to effectively contest the case.</p>
<p>Section 138 and Section 142 of the Negotiable Instruments Act, 1881 lay out the procedure for challenging the Dishonour of a Cheque and the rule of <strong>30-15-30</strong> is to be noted.</p>
<p>Once a Cheque is deposited and returned by a Bank as Dishonoured, the Receiver of the Cheque must issue a Notice under Section 138 (b) of the Negotiable Instruments Act, 1881 to the Giver of the Cheque within <strong>1 month from receiving such endorsement from the Bank</strong>.</p>
<p>Once the Notice is issued and received by the Giver of the cheque, Section 138(c) grants the Giver <strong>15 days’ time from the date of receiving such Notice</strong> to make good the payment.</p>
<p>Once this 15 day period lapses, if the Giver of the Cheque does not honour the cheque by paying the amount to the Receiver of the Cheque, Section 142 (b) of the Negotiable Instruments Act, 1881 gives Receiver of the Cheque has <strong>1 month time</strong> within which he must file a Complaint before the Jurisdictional Magistrate. This 1 month begins after 15 days’ time given to the Giver of the cheque has lapsed.</p>

<p>Divorce by Mutual Consent is simple, economical and time efficient. It makes the difficult, emotional and sensitive time for a couple legally convenient.</p>
<p>Under Section 13B of the Hindu Marriage Act, 1955, the Husband and Wife may file a Joint Petition seeking Divorce by Mutual Consent i.e. both parties state that they want to end the marriage in amicable terms, and agree to a certain set of terms and conditions, and thus request the Court to grant Divorce.</p>
<p>Once such a Joint Petition is filed, there is a mandatory 6-month statutory cooling period before the case proceeds further. This period is given to parties to try to resolve their differences and to examine whether they can reunite. As such, once filed, the hearing date would be given 6-months subsequently.</p>
<p>In the year 2018, the Hon’ble Supreme Court laid out a Judgment stating that in the event certain conditions are fulfilled, or certain circumstances exist, this 6-month statutory cooling period can be waived off by the concerned Court. The parties would be required to apply by filing an Interlocutory Application stating the reason and they may also annex supporting documents. This grant of Waiver of the 6-month statutory cooling period is granted at the absolute discretion of the Court.</p>
<p>Once the statutory cooling period is waived, the parties proceed to record their mutually agreed terms and conditions and present it to the Court for grant of Divorce. The Courts do review the terms and conditions so decided by the parties to ensure that it is legal, before taking into consideration.</p>

<p>A General Power of Attorney is a legal document through which one person authorizes another to perform an act on behalf of the first person. Typically, such documents are beneficial for entities which require delegation of activities to a certain person or for an individual who cannot be physically present for any activity that requires such presence. For eg: A Trust may execute a General Power of Attorney to an Office Bearer for carrying out activities of the Trust.</p>
<p>As the term suggests, this legal document is “general” in nature, and does not contain a specific list of activities that the delegated person can or cannot do, but instead gives a general sphere of role.</p>
<p>If the subject matter is not general but restricted to something either specific, i.e. a special task is outlined and power is given only for carrying out that particular task, then it is not a General Power of Attorney but a Limited Power of Attorney or Special Power of Attorney. For eg. An Apartment Owners Association may execute a Special Power of Attorney to its office bearer for representing the Association in a case in Court; the Proprietor of a Company authorizes his son to act as his Attorney for conducting a case for recovery of money.</p>
<p>A Power of Attorney may be registered, or can be printed on Stamp Paper of adequate value and attested by Notary Public. The situation in which the General Power of Attorney is required to be used will provide for registration or attestation.</p>
<p>Such Power of Attorney can be valid for a specific period of time, or till the act is completed or carried out. It is recommended that the Power of Attorney be time-specific and not vague. In case of a time-bound Power of Attorney, a second one can always be executed.</p>
